Hush Hush Snap Snap Terms of Use

PLEASE READ THESE TERMS CAREFULLY. These Terms of Use and End User License Agreement ("Terms") govern your download and use of the Hush Hush Snap Snap application and its features (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.


1. Acceptance and eligibility

You must be at least 13 years old, or the higher minimum age required by the law of your country of residence (up to 16 in parts of the EU), to use the App. If you are under 18, a parent or legal guardian must review and accept these Terms on your behalf and supervise your use of the App, including the silent-capture and audio-recording features. The App is not directed to children under 13 and is not designed to collect personal information from children under 13. Purchases and subscriptions made by minors are subject to Apple's Family Sharing and Ask to Buy controls; TRP is not responsible for purchases or subscriptions Apple processes.

2. License grant

Subject to these Terms, TRP grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on an Apple-branded product that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules in the App Store Terms of Service. This is a license, not a sale. TRP and its licensors retain all rights not expressly granted.

3. Paid tiers, subscriptions, the free trial, and payment

Free features. The App's core camera functions are usable without payment. The Snappy Kit reading tools — Text Grab and Fine Print — are free. They are accessibility features, and it is TRP's intention that they remain free.

Paid tiers. The App offers two paid tiers, sold by Apple as in-app purchases within a single App Store subscription group:

Each tier is offered on more than one billing period, and Ultra Snapped is additionally offered as a one-time Lifetime purchase that never renews. What each tier currently includes, and the price for your App Store storefront, are shown in the App before you buy and on the App Store listing. Prices vary by country and region under Apple's pricing. The in-app purchase screen and the App Store listing govern; this Section describes how the tiers work, not what they cost.

Auto-renewing subscriptions — terms you should know. Except for the Lifetime purchase, the paid tiers are auto-renewable subscriptions:

Lifetime. Ultra Snapped Lifetime is a one-time, non-consumable purchase. It does not renew, and it is not a subscription.

Free trial. The App offers a 7-day free trial, which grants the Ultra Snapped tier while it is active. The trial is opt-in — it begins only when you tap to start it on the App's upgrade screen, and it never starts automatically. It is not an App Store introductory offer: it is managed by the App on your device, it requires no payment information, and it never converts into a charge. At the end of 7 days, paid features lock unless you subscribe or purchase. The trial creates no recurring charge of any kind.

If you already bought the one-time Pro unlock. The previous one-time Pro purchase (`com.thomasray.hhss.pro`) is no longer sold. If you bought it, you keep it. You are not required to subscribe, you will not be charged again for it, and your purchase is not revoked. TRP grants prior purchasers access to the Ultra Snapped tier — the highest tier — at no further charge. This commitment concerns your entitlement within the App; it is not a guarantee that the App will remain available or compatible with future versions of iOS or hardware (see the last paragraph of this Section).

Family Sharing is enabled for every paid tier and for the Lifetime purchase.

Restore Purchases is available in Settings. Promotional codes, if offered, are redeemed through Apple (apps.apple.com/redeem) and are managed by Apple.

Refunds and cancellation are handled solely by Apple. TRP cannot process a refund, cancel a subscription, or see your payment details. Request refunds at reportaproblem.apple.com. Manage or cancel a subscription in your Apple Account settings.

Price changes. TRP may change prices. Any change to the price of an existing subscription is handled through Apple in accordance with Apple's then-current rules, which may require your consent or provide you advance notice before the change takes effect; you may cancel at any time in your Apple Account settings. A price change does not affect a completed one-time purchase.

What a paid tier is, and is not. Access to paid features is a license right for as long as your subscription is active — or, for a one-time purchase, for as long as the App functions. It is not a guarantee that the App will remain available, be compatible with future versions of iOS or hardware, or continue to function indefinitely. If TRP withdraws the App from sale, or if operating-system or hardware changes break compatibility, your practical ability to use the App may end; refunds remain governed solely by Apple.

4. Your captures

Photos and videos you capture with the App ("Captures") are yours. TRP claims no ownership of and no license to your Captures. Captures are saved directly to your device's Photos library; TRP does not receive, hold, transmit, or store your Captures on any server. If you use Apple's iCloud Photos, Apple may sync your Captures across your devices — that is your relationship with Apple, not with TRP.

Captures may include Live Photos (a short audio-and-video segment), Cinematic video (which carries depth information), and Spatial video (recorded in 3D), and may include standard EXIF metadata and — if you enable location tagging — GPS coordinates. All of this data is written into the file on your device and travels with the file if you share or export it (Section 5(f)).

Snappy Kit results you save. If you save a Text Grab or Fine Print result, it is stored in the App's own storage on your device. It is yours: TRP claims no ownership of and no license to it, and it is never transmitted to TRP. If you save a magnified image from Fine Print into your Photos library, it is a Capture for the purposes of these Terms. Saved results are stored only on your device and are deleted when you delete the App.

5. Acceptable use of silent capture

You are solely responsible for your use of the App and for compliance with all laws of every jurisdiction where you use it. The examples below are illustrative and not exhaustive; your obligation to use the App lawfully applies to all uses, whether or not listed here.

(a) Shutter-sound jurisdictions. In Japan, the Republic of Korea, and other jurisdictions where industry standards, regulations, or social norms expect an audible shutter sound, you will enable the audible-cue toggle and any other indicator required to comply. The App may default the audible cue to ON in those regions; you may disable it only where local law permits, and you remain solely responsible for compliance. You acknowledge that the iOS system shutter sound is controlled by Apple at the operating-system level and that the App neither suppresses nor can suppress it.

(b) Audio recording. The Video Timer mode records audio together with video, and Live Photos capture a short audio segment. You represent and warrant that, before recording audio of any other person, you have obtained the consent required by applicable law. You acknowledge that "two-party" or "all-party" consent laws apply in California, Connecticut, Delaware, Florida, Hawaii, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, Vermont, and Washington (United States), and that the GDPR and EU/UK and member-state laws require a lawful basis (typically the person's consent) to record identifiable persons.

(c) Restricted locations. You will not use the App where photography or recording is prohibited, including theaters and concert venues, professional sporting events, museums and galleries that prohibit photography, courthouses, government and military buildings, schools (and not in violation of FERPA where applicable), healthcare facilities and any place where HIPAA-protected information may be visible, workplaces where employer policy prohibits it, religious ceremonies where prohibited, national parks and wildlife areas where prohibited, theme-park attractions and rides where prohibited, and aircraft cabins where prohibited by the carrier or aviation authority. This applies to the Snappy Kit tools as well as to the camera — pointing the App at a document, screen, sign, or object to read or magnify it is still use of the camera, and may still be prohibited where you are.

(d) Universal prohibitions. You will not use the App, and will not permit any third party to use the App, for: voyeurism, "upskirting," "downblousing," or any covert recording where the subject has a reasonable expectation of privacy; recording in restrooms, locker rooms, changing rooms, dressing rooms, bedrooms, treatment rooms, hotel rooms occupied by others, or any place of solitude; stalking, harassment, intimidation, or domestic abuse; violations of anti-paparazzi laws (including California Civil Code §1708.8); unlawful recording of minors; creation or distribution of non-consensual intimate imagery (including conduct prohibited by California Civil Code §1708.85 and analogous laws); industrial or commercial espionage, including using the reading or magnification tools to capture confidential, proprietary, or trade-secret information you are not entitled to; or any other use that violates any applicable law.

(e) Subject rights. Captures may contain identifiable people. You are solely responsible for obtaining any consents, releases, or lawful bases required to capture, retain, use, publish, or distribute those images, including (where applicable) a GDPR Article 6 lawful basis, GDPR Article 9 explicit consent for special-category data, California Civil Code §3344 consent for any commercial use of likeness, and any local image-rights or personality-rights consent.

(f) EXIF and GPS metadata. Captures contain standard EXIF metadata (such as date, time, and camera settings) and, if you enable GPS tagging, your location coordinates. This metadata is written into the file on your device and travels with the file when you share or export it. The App does not automatically strip metadata from your files. The Snappy Kit Metadata Editor lets you inspect and remove metadata yourself; using it is your choice and your responsibility, and its limits are set out in Section 6(c). You are solely responsible for removing metadata before sharing if you do not want recipients to see it, and for confirming that it was in fact removed.

(g) Hardware shutters and Lock Screen capture. The App may be launched from the iOS Lock Screen and triggered by hardware controls, including the Camera Control button, the Volume Down button, and an AirPods stem-click. You acknowledge these can result in capture from a pocket or bag, and that subsection (d) applies to all such captures.

(h) Automatic and remote capture. The App offers features that fire the shutter without a manual press — including Auto Snap (which captures automatically when it detects a framed subject), the hands-free smile, palm, and voice triggers, the countdown timers, and the Apple Watch remote shutter. You are responsible for every image these features capture exactly as if you had pressed the shutter yourself, including obtaining any consents required by subsections (b), (d), and (e).

(i) Dark Ride Mode and low-light venues. Dark Ride Mode dims the screen and suppresses the flash, torch, and screen-flash cues so the App does not emit light that disturbs others in a dark venue. It is provided for legitimate, courteous use where photography is permitted. It does not relax any venue's rules or any law: you remain solely responsible for complying with the photography, recording, and conduct policies of any venue, attraction, theater, or ride you are in, and with all applicable law. Do not use Dark Ride Mode, or any App feature, to capture where photography or recording is prohibited.

(j) Editing your own files. The Snappy Kit Metadata Editor changes photo files. If you choose the edit-in-place option, it changes the original photo in your library, and that change may not be reversible. You are responsible for keeping your own backups before you edit anything you cannot afford to lose, and for confirming that the result is what you intended. Use the Metadata Editor only on photos you own or are otherwise entitled to modify. Section 6(c) sets out the limits of this feature.

6. On-device AI output and recognition tools

Several features use Apple's on-device models to generate suggestions for you, or to recognize and read what the camera sees. All of it runs on your device. The App does not send your photos, your typed or dictated text, the text it recognizes, the metadata it reads, or any result to TRP or to any third-party AI service.

(a) AI-generated suggestions. Certain features use Apple's on-device machine-learning models to generate suggestions for you — including short photo captions and title suggestions (Smart Titles) and the camera settings produced when you turn a typed or dictated scene description into a Scene Preset ("AI Output").

(b) Text recognition, magnification, and Read Aloud. Text Grab recognizes text the camera sees. Fine Print freezes a still so you can magnify it and raise contrast. Read Aloud speaks recognized text using Apple's on-device speech synthesis.

THESE ARE ASSISTIVE FEATURES. THEY ARE NOT A SUBSTITUTE FOR READING THE ORIGINAL. Optical character recognition can misread, omit, transpose, merge, or supply characters that are not there — particularly with unusual or decorative typefaces, handwriting, low light, glare, motion, damaged, folded, or curved surfaces, small or dense print, low-contrast printing, multi-column layouts, and languages or scripts the recognizer does not fully support. Read Aloud speaks what the App recognized, which may differ from what is actually printed, and may mispronounce or misread numbers, units, abbreviations, and symbols. Magnification and contrast enhancement change how an image looks and can make some detail harder, not easier, to read.

DO NOT RELY ON THESE FEATURES WHERE AN ERROR COULD CAUSE HARM. This includes, without limitation: medication names, dosages, strengths, and warnings; allergen, ingredient, and nutrition information; safety, hazard, chemical, or emergency instructions; financial figures and account details; legal, contractual, official, or identity-document text; and any medical, dosing, diagnostic, or clinical information. Always verify against the original document, and consult a qualified professional where the subject calls for one. TRP is not responsible for any decision you make or action you take based on text the App recognized, displayed, magnified, or spoke.

(c) Metadata Editor. The Metadata Editor shows you the metadata inside a photo you select and lets you change or remove it.

TRP DOES NOT WARRANT THAT ANY EDIT OR REMOVAL WILL SUCCEED, WILL REMOVE EVERY FIELD, WILL REMOVE METADATA FROM EVERY COPY OR VERSION OF A FILE, OR WILL PRODUCE A FILE THAT ANY PARTICULAR APPLICATION CAN READ. Metadata may persist in another copy of the file, in a cloud backup, in a version history, in a file you have already shared, in a derivative or exported image, or in a thumbnail or preview — none of which the App controls or can reach.

IF YOU ARE REMOVING LOCATION OR OTHER METADATA FOR PRIVACY OR SAFETY REASONS, VERIFY THE RESULT YOURSELF BEFORE YOU SHARE THE FILE. Do not treat a successful-looking edit as proof that a file is safe to share. Editing in place changes your original photo and may be irreversible; keep your own backups (Section 5(j)).

7. QR codes, barcodes, and third-party destinations

The App can scan QR codes and barcodes. Scanning and decoding happen entirely on your device. Before the App opens a link, joins a network, adds a calendar event, or shows a contact from a scanned code, it shows you the decoded content and acts only when you choose to proceed:

TRP does not control, operate, endorse, or vet any third-party website, network, server, business, or other resource reached through a scanned code, and does not warrant its availability, safety, accuracy, or content. You access any such destination at your own risk, and your dealings with any third party are solely between you and that third party. You are responsible for reviewing a destination before you proceed, and for deciding whether to open a link, join a network, add an event, or save a contact.

8. Access codes and anti-circumvention

Certain free features can be unlocked by entering an access code ("Club Mode"). Access codes are validated entirely on your device and are provided for your personal use; TRP may change, add, or revoke codes at any time. Access codes unlock only free functionality — they are not a means of obtaining the paid features, which are available only through an App Store purchase or subscription. You will not distribute access codes in violation of these Terms or use them to misrepresent that you hold a paid tier.

You will not circumvent, disable, or interfere with the App's entitlement checks, the free-trial mechanism, the access-code mechanism, or any other technical measure that controls access to features — except to the extent (and only to the extent) that applicable law expressly permits it notwithstanding this restriction, including the rights to observe, study, and test, and to decompile for interoperability or error correction, under Articles 5(3) and 6 of EU Directive 2009/24/EC and analogous provisions of the law of your jurisdiction. Nothing in this Section purports to waive a non-waivable statutory right.

9. Feedback

If you choose to send TRP suggestions, ideas, comments, bug reports, or other input through the App's in-app feedback form, by email, or through a private support channel ("Feedback"), you grant TRP and its successors a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable (through multiple tiers), and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works of, publicly display and perform, and distribute the Feedback, in any media now known or later developed, for any lawful business purpose — including improving the App, analytics, support, and aggregated reporting. To the extent any right in your Feedback cannot be licensed, you assign it to TRP where permitted by law and otherwise agree not to assert it against TRP to the maximum extent permitted by law. You represent and warrant that (a) you have all rights necessary to grant this license; (b) the Feedback does not infringe, misappropriate, or violate any third party's rights or any law; and (c) the Feedback is not confidential, and you waive any expectation of confidentiality in it. TRP may already be developing, or may independently develop, ideas similar to your Feedback; nothing here restricts that. You have no obligation to provide Feedback, and TRP has no obligation to use, respond to, or compensate you for it.

Public reviews are excluded from the license above. Nothing in these Terms restricts, penalizes, or requires you to assign or transfer any intellectual-property right in any review, rating, testimonial, social-media post, or other public "covered communication" you may make about the App, and nothing here conditions any benefit on the content of such a communication. If you post a public review or testimonial, you grant TRP only a non-exclusive, royalty-free license to quote, display, and reference that publicly posted content (with attribution as posted) for informational and promotional purposes, to the extent permitted by law; TRP will not attribute Feedback or a review to you by your real name without your separate consent. This Section is intended to comply with the Consumer Review Fairness Act (15 U.S.C. 45b) and analogous laws, and will be read to do so.

Participation in beta testing (including Apple TestFlight) is voluntary and uncompensated.

10. Privacy

Your use of the App is also governed by the Hush Hush Snap Snap Privacy Policy, available at https://thomasraypublishing.com/hush-hush-snap-snap/privacy.html and in Settings. The App processes Captures on your device and uses only Apple infrastructure (CloudKit and StoreKit); it has no TRP-operated server and no user accounts. The Snappy Kit tools run entirely on your device and make no network requests.

11. Intellectual property

The App, the "Hush Hush Snap Snap" name, the app icon, the user interface, and all related content and marks are owned by TRP or its licensors and are protected by intellectual-property laws. "Hush Hush Snap Snap" is a common-law trademark of Thomas Ray Publishing LLC. Apple, iPhone, iOS, watchOS, App Store, Camera Control, AirPods, Face ID, iCloud, SwiftUI, CloudKit, and related marks are the property of Apple Inc.; their use in the App is for identification only and does not imply endorsement. You may not copy, modify, distribute, sell, lease, or create derivative works of the App except as these Terms allow.

You may not reverse engineer, decompile, or disassemble the App, except to the extent (and only to the extent) that applicable law expressly permits it notwithstanding this restriction — including the rights to observe, study, and test, and to decompile for interoperability or error correction, under Articles 5(3) and 6 of EU Directive 2009/24/EC and analogous provisions of the law of your jurisdiction (including Australian law). Nothing in these Terms purports to waive a non-waivable statutory right.

The App incorporates only Apple system frameworks and components owned by Thomas Ray Publishing — including its local Swift packages TimerKit, TimeLapseKit, FramingKit, SessionKit, RecognitionKit, DiagnosticKit, and UpdatePromptKit. It includes no third-party open-source software that requires separate attribution or notice, and no third-party software development kit of any kind.

12. Apple-required provisions

This Section is required because the App is distributed through the Apple App Store under a custom end-user license agreement. These provisions are consistent with, and do not limit user rights granted by, the Apple Media Services Terms and the Apple Standard Licensed Application End User License Agreement; in the event of a conflict, the user-protective provisions of those Apple terms control.

  1. Parties. These Terms are between you and TRP only, not Apple. TRP, not Apple, is solely responsible for the App and its content.
  2. Scope of license. The license granted in Section 2 is non-transferable and limited to use on Apple-branded products you own or control, subject to the Apple Media Services Terms (including the Family Sharing rules for the paid tiers).
  3. Maintenance and support. TRP, not Apple, is solely responsible for any maintenance and support for the App. Apple has no obligation to furnish maintenance or support.
  4. Warranty. TRP is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
  5. Product claims. TRP, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, claims under consumer-protection or similar legislation, and claims arising under privacy law.
  6. Intellectual-property claims. TRP, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your use of it infringes that party's intellectual-property rights.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints, or claims regarding the App should be directed to TRP at contact@thomasraypublishing.com.
  9. Third-party terms. You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless carrier's terms).
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.

13. Maintenance and support

TRP provides the App on a best-efforts basis and may, but is not obligated to, provide updates, bug fixes, or support. TRP may modify, suspend, or discontinue the App or any feature at any time, subject to Section 3 — including the commitment in Section 3 to prior purchasers of the one-time Pro unlock.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TRP DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, TRP DOES NOT WARRANT THAT: the silent-capture feature will be silent in every environment, on every device, or in every iOS version; Captures will save successfully; EXIF or GPS metadata will be present, complete, or accurate; Night modes, HDR, stabilization, haptics, or any image processing will produce any particular quality or result; any AI-generated caption, title, or scene-preset setting will be accurate, appropriate, or fit for any purpose; any text recognized, magnified, or spoken by the Snappy Kit tools will be accurate, complete, correctly ordered, or correctly pronounced (Section 6(b)); any metadata edit or removal will succeed, will remove every field, or will leave no metadata in any copy, backup, version, or derivative of a file (Section 6(c)); any saved Snappy Kit result will be retained, recoverable, or exportable; any QR code or barcode will be decoded accurately or that a decoded destination will be safe or available; or the App will be compatible with future iOS versions or hardware.

Mandatory consumer rights. If you are a consumer in the EU, the UK, Australia, Brazil, India, or any other jurisdiction that grants non-excludable consumer rights or guarantees, the disclaimers in this Section do not limit those rights, which apply in addition to these Terms.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR LIABILITIES THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED — INCLUDING (I) FRAUD, FRAUDULENT MISREPRESENTATION, AND WILLFUL INJURY TO THE PERSON OR PROPERTY OF ANOTHER UNDER CALIFORNIA CIVIL CODE §1668; (II) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE UNDER THE UK CONSUMER RIGHTS ACT 2015 §65 OR ANALOGOUS EU MEMBER-STATE LAW; (III) NON-EXCLUDABLE GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW; AND (IV) NON-WAIVABLE STATUTORY CONSUMER REMEDIES UNDER BRAZIL'S CONSUMER DEFENSE CODE AND INDIA'S CONSUMER PROTECTION ACT, 2019 — TRP AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST CAPTURES, OR LOST OR ALTERED FILES; AND TRP'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$50 OR (B) THE TOTAL AMOUNTS YOU PAID TRP FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE PARTIES ACKNOWLEDGE THAT THIS ALLOCATION OF RISK REFLECTS THE PRICE PAID. WHERE A JURISDICTION DOES NOT PERMIT ONE OF THESE LIMITATIONS OR EXCLUSIONS, IT IS REDUCED TO THE MINIMUM PERMITTED BY THAT JURISDICTION'S LAW RATHER THAN VOIDED, AND THE REMAINDER OF THIS SECTION REMAINS IN EFFECT.

16. Indemnification

To the extent permitted by applicable law, you will indemnify and hold harmless TRP and its members, employees, contractors, and licensors from third-party claims, damages, losses, and reasonable expenses (including reasonable attorneys' fees) arising out of (a) your violation of Section 5 (Acceptable Use); (b) your use of the App in violation of any law or any third party's privacy, publicity, or intellectual-property rights; (c) your submission of Feedback that infringes a third party's rights; (d) your access to or dealings with any third-party destination, network, or resource reached through a scanned code (Section 7); (e) your use, publication, or distribution of AI Output (Section 6(a)); or (f) your use of the Snappy Kit tools, including any editing or removal of metadata, any file you altered, and any reliance on text the App recognized, magnified, or spoke (Sections 6(b) and 6(c)). TRP will give you prompt notice of any such claim, may participate in the defense with counsel of its choice, and you will reasonably cooperate; you will not settle any claim in a way that imposes any obligation or admission on TRP without TRP's prior written consent. This indemnity does not apply to the extent a claim arises from TRP's own breach, negligence, or willful misconduct, and your aggregate indemnity obligation is subject to the same limitations and carve-outs as Section 15. If you are a consumer in a jurisdiction that restricts consumer indemnities, this Section applies only to the extent that jurisdiction permits.

17. Term, termination, and survival

These Terms apply while you use the App. You may terminate by deleting the App. TRP may suspend or terminate your license for material breach of these Terms (including any violation of Section 5).

Deleting the App does not cancel an auto-renewing subscription. To stop a subscription from renewing, turn off auto-renewal in your Apple Account settings (Section 3). On termination, amounts already paid are not refunded by TRP, and refunds remain governed solely by Apple (Section 3).

Sections 3 (as to completed purchases and the commitment to prior purchasers), 4, 5, 6, 7, 8, 9, 11, 14, 15, 16, 17, 18, 19, and 21 survive termination.

18. Dispute resolution

Informal resolution first. Before starting any proceeding, you and TRP agree to try to resolve the dispute informally for 30 days after written notice to contact@thomasraypublishing.com.

For users who reside in the United States: You and TRP agree that any dispute arising out of or relating to your use of the App or any purchase or subscription will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and its Consumer Arbitration Minimum Standards of Procedural Fairness, rather than in court, except as stated below. You and TRP waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action or class arbitration.

For users who reside outside the United States: Nothing in this Section requires you to arbitrate. You retain all mandatory rights under the consumer-protection law of your country of residence, including, where applicable, the right to bring proceedings in the courts of your country of habitual residence (e.g., under Brussels I Recast Articles 17–19), and rights under Brazil's Consumer Defense Code, India's Consumer Protection Act, 2019, the UK Consumer Rights Act 2015, and the Australian Consumer Law. These rights are not waived or overridden by these Terms.

Severability of this Section. If any part of this Section is unenforceable in a given jurisdiction, the remainder remains enforceable where it lawfully can be.

19. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to Section 18, the exclusive venue for any permitted court proceeding is the state and federal courts located in Contra Costa County, California. If you are a consumer, the mandatory law of your country of residence may grant you additional rights and a right to bring proceedings locally, and nothing in this Section overrides those rights.

20. Changes to these Terms

TRP may update these Terms. For material changes, TRP will present the updated Terms in the App and ask you to accept them before continued use. For non-material changes (such as corrections or contact-information updates), the updated Terms take effect when posted, and continued use constitutes acceptance. The current version and effective date appear at the top. No change applies retroactively to a dispute that arose before the change.

21. General

These Terms, together with the Privacy Policy, are the entire agreement between you and TRP regarding the App. If any provision is held unenforceable, the rest remains in effect, and the unenforceable provision is limited to the minimum extent necessary. TRP's failure to enforce a provision is not a waiver. You may not assign these Terms; TRP may assign them, including in connection with a merger, acquisition, or sale of assets, on notice. Notices to you may be given in the App or by the contact method you provide to the App Store; notices to TRP go to contact@thomasraypublishing.com. Neither party is liable for delays or failures caused by events beyond its reasonable control. Nothing in these Terms creates an agency, partnership, or joint venture. Headings are for convenience only. These Terms are written in English; any translation is provided for convenience, and the English version controls except where local law requires otherwise.
